What Does the Crown Need to Prove?
Under the Controlled Drugs and Substances Act (CDSA - Canada's drug law), simple possession requires three things: you had the substance, you knew it was a controlled substance, and you had control over it. Trafficking requires you to have sold, given, or offered to give the drug to someone. "Possession for the purpose of trafficking" is inferred from quantity, packaging, scales, and cash. That inference is what the defence challenges.
How Do You Challenge a Drug Search in Ajax or Pickering?
